User Agreement

1. Scope and Effectiveness

This User Agreement ("Agreement") is a legally binding agreement between you and HONG KONG TOONSHORT TECHNOLOGY LIMITED ("we", "our", or "ToonShort") regarding your use of the ToonShort application, website, and all related services (collectively, the "Services").

Certain features or services may be subject to additional terms (e.g., Membership Terms, Paid Services Terms, Privacy Policy, Content Submission Terms). If there is any conflict between this Agreement and those specific terms, the specific terms shall prevail.

2. Eligibility and Age Requirements

ToonShort is not intended for children under the age of 13 ("Children").

• Children must not use the Services for any purpose. We do not knowingly collect personal information from users under 13. If we discover that a user under 13 has created an account or submitted information, we will promptly delete the relevant content and terminate the account.

Users aged 13 to 18 ("Minors") may use the Services only if:

1. Ensure the Minor and their parent/legal guardian have reviewed and agreed to this Agreement in advance; and
2. Require the Minor to use an account created by their parent/legal guardian and only under their supervision and permission.

By allowing a Minor to use the Services, the parent/legal guardian acknowledges and agrees to this Agreement on behalf of themselves and the Minor, and assumes full legal responsibility for all activities conducted by the Minor.

3. Account Registration and Management

3.1 Registration Information

Some features require a ToonShort account. You must ensure that all information provided is accurate, truthful, lawful, and up to date.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. If you detect any unauthorized access or abnormal activity, please contact us immediately at service@toonshort.com.

3.3 Third-Party Login

You may choose to log in via Google, Facebook, or other supported third-party platforms. You must comply with their respective terms of service.

3.4 Account Deletion

To request account deletion, please contact us via email.

• Once deleted, your account and related data cannot be restored.
• If your account is suspended or terminated due to violations, we reserve the right to refuse reinstatement.

4. Service Content

ToonShort provides services including but not limited to:

• Short-drama browsing and playback
• Episode unlocking and membership services
• Personalized recommendations
• Comments, likes, and interactive features
• Virtual currency purchase and payment
• Other features introduced over time

We may add, modify, or discontinue certain features based on business needs.

5. User Conduct Guidelines

You agree not to engage in any illegal or prohibited behaviors, including but not limited to:

1. Engaging in illegal, pornographic, gambling-related, violent, or vulgar content
2. Violating others' intellectual property rights, privacy, or other lawful rights
3. Using plugins, scripts, crawlers, reverse engineering, or other methods to disrupt service security
4. Posting advertising, spam, or malicious promotional content
5. Impersonating others, falsifying identity, or spreading misleading information
6. Circumventing paywalls or accessing content through unauthorized means

If you violate any of the above rules, we may, at our discretion:

• Delete content
• Restrict certain functions
• Suspend or terminate your account
• Pursue legal liability

6. Content and Intellectual Property Rights

6.1 Platform Content

All content within ToonShort—including short dramas, images, videos, audio, texts, software, and interface design—is legally protected and owned by ToonShort or its licensors. Unauthorized recording, copying, distribution, adaptation, or extraction of content is strictly prohibited.

6.2 User-Generated Content (UGC)

You must ensure that all content you submit (comments, nicknames, avatars, etc.) is lawful and does not infringe the rights of any third party. By submitting content on ToonShort, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, distribute, display, and promote your content within the Services. We may delete any unlawful or inappropriate content at our discretion.

7. Paid Services & Subscriptions

Some services require payment, including:

• Episode unlocking
• VIP membership
• Virtual coin purchases
• Limited-time privileges or bundles

7.1 Payment Methods

Payments can be made through platforms such as Apple App Store and Google Play.

7.2 Apple Subscription Terms (iOS)

1. Confirm that your Apple ID will be charged after confirmation
2. Disable automatic renewal at least 24 hours before the subscription expires
3. Allow renewal fees to be automatically charged within 24 hours prior to expiration

7.3 Google Play Subscription Terms (Android)

• Subscription fees are charged to your Google Play account.
• Subscriptions renew automatically; Google Play will charge the renewal fee within 24 hours before expiration.
• To cancel automatic renewal, users must do so in Google Play's "Subscription Management" page at least 24 hours before the renewal date.
• Refunds follow Google Play's refund policies and must be submitted through Google's official channels.
• ToonShort cannot modify or cancel Google Play subscription settings on your behalf.

8. Protection of Minors

Minors using the Services under guardian supervision should use the app appropriately, avoid excessive usage, and avoid exposure to unsuitable content. Guardians bear full responsibility for supervision and guidance.

9. Third-Party Services

The Services may include links to third-party websites or features (e.g., payment providers, advertisements). Such third-party services operate independently, and ToonShort is not responsible for their actions, content, or safety.

10. Privacy Protection

We collect, use, and protect your personal information according to our Privacy Policy. Please read and agree to the Privacy Policy before using the Services.

11. Service Changes, Interruptions and Termination

The Services may be suspended or terminated due to:

• System maintenance or upgrades
• Legal or regulatory requirements
• Force majeure
• User violations

We will notify users when feasible.

12. Disclaimer

To the maximum extent permitted by law, ToonShort shall not be liable for:

• Network failures or device failures
• Third-party service outages
• Hacks, viruses, or security vulnerabilities
• Losses caused by user error
• Accuracy or availability of content

13. Limitation of Liability

Unless otherwise required by law, our maximum liability to you shall not exceed:

• The amount you paid to ToonShort within the past six (6) months, or
• USD $100, whichever is higher.

We are not liable for indirect, incidental, or consequential losses, including lost profits or data loss.

14. Governing Law & Dispute Resolution

This Agreement is governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall first be resolved through friendly negotiation. If negotiation fails, disputes shall be submitted to the Hong Kong International Arbitration Centre (HKIAC) for arbitration, and the decision shall be final and binding.

15. Amendments to the Agreement

We may modify this Agreement based on business adjustments or legal requirements. Continued use of the Services signifies your acceptance of the updated version.
